This Agreement is between DreamCore Productions, Ltd. doing business as
Photoshopdesigner.com (Photoshopdesigner.com, We or Us ) and the user (You).
For the purpose of this Agreement, "Content" is defined as any image, photo, .psd
file, layered .psd file, or design represented in these 2 discs or downloaded
files from the iPSD Designer Series on PhotoshopDesigner.com or Hi-Fi.Tv. You have agreed
to be bound by the Terms and Conditions of this Agreement and by using any of
the Content from these discs, You acknowledge that You have read, understood,
and accepted the Terms and Conditions of this Agreement.
Photoshopdesigner.com is authorized to allow You to use Content under the Terms
and Conditions of this Agreement. The copyright and all other rights of the
Image(s) shall remain with Photoshopdesigner.com and DreamCore Productions, Ltd.
Terms and Conditions of Use:
You agree to use the Content under the following Terms and Conditions:
These Terms and Conditions constitute a legal Agreement between You and
Photoshopdesigner.com
Photoshopdesigner.com grants You a nonexclusive, nontransferable license to use
and modify the Content according to the Terms and Conditions of this Agreement.
You may, subject to the Terms and Conditions of this Agreement, use the Content
for the following purposes, provided you do not violate the rights of any third
party:
(First Edition Bonus: Disc I and II and iPSD Designer Series Online) Institutional, Personal, self-educational, or non-profit use in
Adobe software and other image-editing, print or web publishing programs.
Content on First Edition Disc I: "Free Images" (does not apply to iPSD Series) (with the exception of the "flyers" folder) UPON REQUEST and
APPROVAL from Us may be used for commercial purposes such as part of marketing
or advertising campaigns, website publication, poster design, or promotional
materials, including print ads, mailers, handouts, and packaging or in video,
film, or television broadcasts.
You may distribute Content from Disc I that you have used in creating your own
designs (not individual Content images) or prints on a small, non-commercial
basis and otherwise according to this EULA. Content on Disc I may be used for
non-commercial websites or multimedia without prior consent of Us.
You must contact orion@photoshopdesigner.com with the Subject: Commercial
License Request; name the files you plan on using commercially and the intended
purpose. Within seven days, You will receive a reply from Us more than likely
granting approval for commercial purposes. There is no limit to the number of
files you can request for commercial use.
Content on Disc II and the "Flyers" folder (on Disc I and the iPSD
Designer Series) are strictly commercial
copyright of Photoshopdesigner.com You may not use THIS Content for any other
purpose than personal or educational use. You are free to use and modify these
images for personal use ONLY.
You agree not distribute or print any files on First Eedition: Disc II and iPSD
Designer Series (and "Flyers") or your
modifications of them for any reason; they are strictly for educational
purposes. Requests for commercial use of iPSD Series, Disc II Content (and "Flyers" Folder on
Disc I) will be denied unless you are willing to negotiate commercial
distribution and license/ownership rights with us.
You may NOT
distribute the Content, electronically or in hard copy; You have personal
license to use these images. You may not authorize any third party to use the
Content for any purpose or resell, sublicense, or otherwise make available the
Content for use or distribution separately or detached from a product or Web
page; share Content across a network, on a CD, or in any other way; use Content
in connection with any pornographic, obscene, immoral, or illegal materials. You
may not claim Content as your own with respect to individual images or designs.
You understand that Content is copyrighted and any unauthorized (commercial) use
by you may be an infringement of such copyright without first receiving proper
consent from Us for commercial purposes.
The Content is made available to you "AS IS," and "WITH ALL FAULTS." You are
free to use All Content for PERSONAL education or modification/use. You may use
Disc I Content (minus "Flyers" folder) for personal multimedia design, print and
production and may not use Disc II (plus "Flyers") for print or distribution
without consent.
Display or distribution of Disc II material may be acquired when including
proper ownership/copyright information AFTER receiving approval upon request.

If you would like to display, purchase or promote any iPSD Series Designs or Disc II Content you may
contact us and we may work out an arrangement.
WE MAINTAIN COMMERCIAL COPYRIGHT TO "CONTENT" AND MAY OR MAY NOT CHOOSE TO
COMMERCIALLY LICENSE CERTAIN IMAGES TO YOU UPON YOUR REQEST.
We make no representation or warranty as to your right to use any individual's
name, likeness, and/or image appearing in the Content without first obtaining
appropriate rights from such individual. You understand and acknowledge that We
have not made any representation or warranty that Your use of Content will
infringe or violate the trademark rights of any third party, or constitute a
false designation of origin or any other form of unfair competition.
You represent and warrant that:
You are at least 18 years of age or are aware that some content may be
inappropriate for those under the age of 18.
Your use of the Content will not violate any applicable law or regulation of any
country, state, or other governmental entity;
You agree to fully defend and indemnify Photoshopdesigner.com and anyone else
associated with Us, and assign Us free and harmless from any and all claims,
liabilities, costs, losses, damages, or expenses, including attorneys' fees and
expenses, arising in connection with Your use of the Content and this Site or of
any breach or alleged breach of any representation, warranty, or other promise
made by You in this Agreement.
Wisconsin law governs this Agreement. The parties consent to jurisdiction over
them in any state or federal court in Wisconsin, waive any claim or defense that
such forum is not convenient, and consent to service of process by any means
authorized by Wisconsin law.
This Agreement constitutes the entire agreement between You and
Photoshopdesigner.com regarding its subject matter.
You have agreed, and reaffirm your agreement to use these files according to
this license agreement.

& other countries.
